Terms and Conditions
Who we are
Kongy Labs, S.L. (“Memsos”). Tax ID (CIF) B05593207. C/ Zurbano 52, 5º D, 28010 Madrid, Spain. hello@memsos.com
These terms govern the use of Memsos in the app and on the web. How we handle your data is set out in a separate document: the Privacy Policy.
How it works
The host creates an event and shares a QR code. Guests scan it, sign in with their name and take photos with the Memsos camera that go to a shared gallery. They don’t need to download anything.
The gallery stays available for as long as the plan purchased includes.
Each guest has a number of photos, set by the host. The ones they take with the camera and the ones they upload from their phone’s gallery come from the same roll.
- The camera closes when the event ends. Until the reveal, photos can still be uploaded from the phone’s gallery; after that, they can’t.
- Only photos and videos taken on the day of the event are accepted. If we can’t check the file’s date (for example, because it was forwarded, downloaded or edited), it isn’t uploaded.
- The host can turn off uploads from the phone’s gallery in the event settings, until the reveal.
- Videos: only if the plan includes them or the extra is added. Each guest can upload up to 3 videos from their gallery, 30 seconds max each. Videos don’t use photos.
Who can use it
Host
- To buy, you must be over 18.
- If you buy for a company, you confirm you can act on its behalf.
Guest
- You must be 14 or older.
- If you’re younger, you need permission from a parent or guardian.
Your access
Host
- Use real details and keep access to your account safe.
- Only share the QR code with your guests: anyone who has it can enter the gallery.
Guest
- We only ask for your name (or a nickname). If you want us to tell you about the reveal, your email too. By signing in, you accept these Terms of Use.
- Using Memsos as a guest is free.
Prices and payments

Free trial
Host only
You can try Memsos without a card: 5 guests, 12 photos and a 48-hour gallery. If you then buy a plan, you keep the gallery and all the photos from the trial. If not, it’s deleted when the trial ends.
How to pay
Host only
- On the web: by card, through a secure payment provider. Memsos never sees or stores your card details.
- In the app on iPhone: payment is taken by Apple (in-app purchase) or, where Apple allows it (in the EU, depending on your iOS version), by our secure payment provider. If Apple takes it, its payment and refund terms also apply.
You’ll receive your invoice by email. If you need it in a company’s name, enter the company’s details when you pay.
Changing plan
Host only
- You can upgrade at any time, paying only the difference.
- If the guest limit is reached, new guests can’t join until you upgrade.
- Downgrading doesn’t entitle you to a refund of the difference.
Withdrawal and refunds
Host only
If you buy as a consumer, you have 14 calendar days from purchase to withdraw without giving a reason. Art. 102 TRLGDCU
- If nobody has uploaded any photos yet, we refund 100%.
- If the event has already started, it’s because you asked for the service to start straight away when you paid. In that case we refund the amount minus the part of the service already provided. Art. 108.3 TRLGDCU
To withdraw, write to hello@memsos.com. We refund you within 14 days at most, using the same payment method.
If you paid through Apple, the refund is requested from Apple at reportaproblem.apple.com, under its terms. Write to us and we’ll help you with it.
If Memsos fails for reasons within our control and we don’t fix it, we refund what you paid for that event.
Gift cards
A gift gives the recipient credit to create their event or upgrade a plan, from “Redeem a gift”. The credit is valid for 12 months from purchase and can’t be exchanged for cash, unless the buyer withdraws within 14 days of purchase.
Invite your friends
Host only
Share your invite link. Your friend gets €10 off their first event (from 50 guests) and you earn up to €25 in credit, depending on the size of their event:
- 50 guests: €10
- 150 guests: €15
- 250 guests: €20
- 500 guests: €25
25-guest events don’t qualify. Only each friend’s first event counts.
- Your credit becomes active as soon as your friend’s event receives its first photo or, failing that, once its 14-day withdrawal period has ended.
- Credit is used on Memsos plans and extras, is personal, can’t be exchanged for cash and expires after 12 months.
- One code per event: the invite link can’t be combined with a partner code or any other code.
- Inviting yourself or creating fake accounts doesn’t count: in that case we may cancel the credit.
Partners
Host only
If you’re a wedding planner, DJ, venue or other professional in the Partners Program, your clients get 10% off any plan with your code, and you earn credit on every paid event booked with it, on the same scale as the invite programme: €10 (50 guests), €15 (150), €20 (250) and €25 (500). 25-guest events and your own events don’t earn credit.
Credit follows the same activation, use and expiry rules as the invite programme, and your code can’t be combined with other codes. Everything else is governed by your partner agreement. If a client books with your code, these terms apply to that client in the same way.
Photos and gallery
Your photos are yours
Everyone remains the owner of the photos and videos they take. By uploading them, you only give us permission for what the service needs to work: storing them, showing them in the event gallery and adapting them to the app’s format.
That permission is free and ends when the gallery is deleted. We don’t use your photos for advertising without asking you first.
What each person can do
Host
- You decide who gets in and when the photos are revealed, and you can delete photos from the gallery.
- You decide whether guests can upload photos from their phone’s gallery, until the reveal.
- You can download the gallery for personal use.
- If it’s a business event, you’re responsible for your attendees’ data. See the “Business events” annex.
Guest
- You can view and download the gallery’s photos for personal use.
- By uploading photos or videos, you accept that the host and the other guests can see and download them.
- You can ask for a photo of yours to be deleted at any time.
Gallery rules
Uploading the following is not allowed:
- nudity, sexual or violent content, or content that incites hatred;
- photos of minors in situations that affect their privacy;
- images of other people against their will or that humiliate them;
- illegal content, content that infringes copyright, or advertising.
An automatic filter blocks inappropriate content before it’s published. We can also remove any content that breaks these rules and block anyone who breaks them. To report something, write to hello@memsos.com.
Outside the gallery
What you do with photos once you’ve downloaded them is your responsibility. Sharing them privately with family or friends is personal use. Posting them on open social media or using them commercially may require permission from the people in them.
How long the gallery lasts
48 hours on the free trial and 12 months with any plan. We’ll let you know before it expires. After that it’s permanently deleted, so download anything you want to keep beforehand.
Everything else
Service and liability
We work to keep Memsos running at all times, but there may be occasional interruptions for maintenance or for reasons outside our control.
- We’re not responsible for photos that aren’t uploaded because of a lack of connection or problems with the guest’s phone.
- Nor for photos or videos that aren’t accepted because they don’t meet the upload rules (date, length or no photos left).
- We’re not responsible for content uploaded by users, although we remove it as soon as we know it breaks the rules.
None of this limits your legal rights as a consumer, or our liability for wilful misconduct or gross negligence.
Closing your account
The host can delete their account at any time from the app or by writing to us. We can suspend an account or a gallery for serious breaches of these terms; we’ll tell you and explain why.
Changes to these terms
If we change anything important, we’ll tell you first by email or in the app. Changes don’t affect events already paid for.
Law and complaints
Spanish law applies. If you have a complaint, write to hello@memsos.com and we’ll reply as soon as possible.
If you buy as a consumer, you can go to the courts where you live and to the consumer arbitration boards.
Annex. Business events: data processing
This applies when the host buys as a business or professional (company dinners, brand events, or partners for their clients). In that case the host is the controller and Memsos is the processor. Art. 28 GDPR
What data, and what for
Attendees’ names, photos and videos (and email, if they sign in with Apple or Google or leave it for the reveal notice), only to provide the gallery service for the contracted period.
What Memsos does
- Processes the data only on your instructions, which are these terms and the settings you choose in the app.
- Ensures its team’s confidentiality and applies appropriate security measures.
- May use technical providers (hosting, email, moderation). They are authorised in general; we’ll tell you if they change and you can object.
- Helps you handle attendees’ requests to exercise their rights and tells you without delay about any security breach.
- When the gallery ends, deletes the data, unless the law requires it to be kept.
- Gives you the information needed to show it complies, including reasonable audits.
What you do
- Inform your attendees and have a legal basis to process their data.
- Give us instructions that comply with the law.
