What data we use
Host
- Your account name and email.
- Event details: name, date, plan and number of guests.
- Billing details (if you ask for an invoice, also your tax ID and address).
- Payment: handled by the payment provider. We never see or store your card.
- Anything you write to us in support.
- The photos you take and the ones you upload from your phone’s gallery, with the date they were taken, just like guests.
- If you give Memsos as a gift: the recipient’s email and your message.
- If you invite friends: who creates an event with your link.
Guest
- Your name (or the nickname you choose). We don’t ask for your email to take part. If you sign in with Apple or Google, that service gives us your name and email, which may be a hidden email.
- Your email, only if you choose to leave it so we can tell you when the album is revealed.
- The photos you take with the Memsos camera and the ones you upload from your phone’s gallery; the videos you upload from your gallery, if the event includes them; and your votes or likes.
- The date each photo or video you upload from your gallery was taken. We read it from the file itself to check it’s from the event day. We don’t keep any location the file may contain.
- Minimal technical data: device type, IP address, upload time and an identifier saved on your phone so that, if you come back to the event, you keep your name and your remaining photos.
You don’t need to download the app or create an account.
What we use it for
Host
- Creating your event, generating the QR code and managing your gallery.
- Charging you and issuing your invoice.
- Telling you about service matters and helping you in support.
- Delivering your gifts and applying the invite programme credit, for you and your friend.
- Sending you information and news about the Memsos app. You can unsubscribe from every email.
Guest
- Letting you take photos and upload photos and videos from your phone’s gallery to the event gallery.
- Checking that what you upload from your phone was taken on the event day and that no one goes over their photos or videos.
- Showing them to the host and the other guests at the event.
- Telling you when the photos are revealed: in the app or, if you leave your email, by email. We only write to you about that event, never with advertising.
- Automatically filtering inappropriate content before it’s published.
Why we can do it
Legal basis
Host
- Providing the service you buy. Contract · Art. 6.1.b GDPR
- Accounting. Legal obligation · Art. 6.1.c
- App news: only about Memsos services similar to the ones you already use, with an unsubscribe link in every email. Art. 21.2 LSSI · Art. 6.1.f
Guest
- Taking, uploading and viewing photos and videos, and checking the date of what you upload from your phone: you accept the terms of use when you sign in. Contract · Art. 6.1.b
- Inappropriate content filter. Legitimate interest · Art. 6.1.f
- Reveal notice by email: only if you leave your email, with your consent, which you can withdraw in every email. Consent · Art. 6.1.a
Security and fair use
We review reported content and protect the platform against abuse. Legitimate interest · Art. 6.1.f
Galleries are private: only people with the event’s QR code or link can get in.
Who else sees it
Host
- Providers that help us run the service (hosting, payments, email delivery), under contract and only for that purpose.
- The partner (wedding planner, DJ, venue…) if you booked the event through them.
- Public authorities and courts, when the law requires it.
Guest
- The host and the other guests at the event see your photos and your name.
- If you sign in with Apple or Google, your email isn’t shown in the gallery or shared with anyone.
- Our technical providers, under contract and only for that purpose.
Outside Europe
If a provider processes data outside the European Economic Area, we do so with EU-approved safeguards (the EU-US Data Privacy Framework or standard contractual clauses).
How long
Host
- Account: for as long as you keep it active.
- Invoices: the period required by law (up to 6 years).
- News: until you unsubscribe.
- Gifts: the recipient’s email, until the gift is redeemed or expires (12 months).
Guest
- Photos, videos (with their date), name and your phone’s identifier (and email, if you sign in with Apple or Google): for as long as the event gallery lasts (48 hours on the free trial, 12 months on any plan). Then they’re deleted.
- Email for the reveal notice: until the gallery closes or you withdraw your consent.
Your photos, your responsibility
Household exemption
If the event is a private celebration (a wedding, a birthday, a dinner with friends), taking photos and sharing them in the private gallery with the other guests is personal or household use. That use falls outside data protection law. Art. 2.2.c GDPR
But it stops being personal use, and you become responsible, if you:
- download the photos and post them on open social media or the internet;
- use them for professional or commercial purposes;
- share images of another person without their permission.
Everyone also has the right to their own image. Before uploading a compromising photo of someone, ask them.
Memsos, as the company providing the service, always complies with the GDPR for the data it processes.
Business events
If you create the event as a business or professional (a company dinner, a brand event, or as a partner for your clients), it is no longer household use. In that case you are the controller of your attendees’ data and Memsos processes that data on your behalf, as processor, under the Terms and Conditions. Art. 28 GDPR
If you write to us or want to become a partner
If you write to us from the website or ask about becoming a partner, we use your name, email, phone number, what you do and your website (if you give it) to reply and assess the partnership. Pre-contractual measures · Art. 6.1.b
We keep them while we handle your request and, if we don’t end up working together, for 12 months at most.
If you’re in a photo
Whoever uploads a photo must have permission from the people in it, especially if they are minors. If you’re in a photo and don’t want to be, write to hello@memsos.com or ask the host: we’ll take it down.
Artificial intelligence
Only as a filter
We use AI only to detect and block inappropriate content before it reaches the gallery.
It doesn’t build profiles, it doesn’t recognise faces and we don’t use your photos to train models. If you think it blocked a photo by mistake, write to us and a person will review it.
Take care with minors
You must be at least 14 to use Memsos. Below that age, you need permission from a parent or guardian.
- Before uploading photos with children in them, ask their parents for permission.
- Never upload photos of minors in situations that affect their privacy.
- Don’t download or share outside the gallery photos of children who aren’t yours.
- If you’re a parent or guardian and want us to remove a photo of your child, write to hello@memsos.com. We’ll take it down, no questions asked.
Your rights
You can ask for access to, correction, deletion, restriction or portability of your data, object to its use, and withdraw any consent at any time. Write to hello@memsos.com with the subject “Privacy”. If you’re a guest, tell us the event name and the name you signed in with.
If you think we can do better, write to us. And if you think we haven’t respected your rights, you can complain to the Spanish Data Protection Agency (www.aepd.es).
Cookies and changes
Cookies on the website have their own policy: Cookie Policy.
If we change anything important in this policy, we’ll tell you first by email or in the app.
